The California Public Utilities Commission (CPUC) wants to hear from you! A series of in-person and remote Public Participation Hearings (PPHs) have been scheduled to hear your comments about potential changes to the CPUC’s licensing and oversight of video franchisees under the Digital Infrastructure and Video Competition Act of 2006. The CPUC is evaluating customer service requirements and a new process for addressing customer complaints.
The dates and times of the PPHs are listed above. A CPUC Administrative Law Judge (ALJ) will be presiding at these PPHs to listen to concerns, comments, and opinions on the application. One or more Commissioners or their advisors may attend, but no decisions will be reached at this hearing. All public comments from these PPHs will be included in the administrative record of this proceeding and become public record. The in-person and remote hearing locations, dates and times, and details on how to view and participate are listed above.
To participate and provide public comment during the in-person PPHs, you must attend the hearing in-person at the address, date and time listed above. To participate and provide public comment during the in-person PPHs, print your name on a list provided by the CPUC. When it is time for public comment, an ALJ will make an announcement for each public speaker to provide comment.
Any customer may observe the remote PPHs via the webcast information provided above. To participate and provide public comment during the remote PPHs, dial the toll-free telephone number and provide the passcode noted above. When it is time for public comment, an ALJ will make an announcement through the telephone line for those who wish to speak. Participants who wish to speak must then press “star one (*1)” to alert the operator, who will queue the speakers one-at-a-time and announce each speaker’s name at the allotted time.
You may also submit written comments at any time directly to the CPUC’s Public Advisor’s Office (PAO) at the address noted at the bottom of this notice. You may also submit written comments by using the “Add Public Comment” button on the “Public Comment” tab of the Docket Card for R.23-04-006 at apps.cpuc.ca.gov/c/R2304006. If you need a language or sign interpreter, or would like to request assisted listening devices, please contact the PAO at least five business days prior to the hearing.
ABOUT THE RULEMAKING
On April 6, 2023, the CPUC issued Rulemaking (“R”) 23-04-006, instituting a rulemaking to consider changes to the licensing and oversight of video franchisees under the Digital Infrastructure and Video Competition Act of 2006 (DIVCA). Senate Bill 28 (Stats. 2021, Chap. 673), signed by the Governor on October 8, 2021, revises DIVCA to require the Commission to adopt video and broadband customer service requirements for a holder of a state video franchise and to adjudicate customer complaints regarding these services. The CPUC may also consider potential ways to modernize and make the implementation of DIVCA more efficient and effective.

CPUC PROCESS
The assigned ALJ will determine how to receive evidence and other related documents necessary for the CPUC to establish a record upon which to base its decision.
After considering all proposals and all evidence presented, the assigned ALJ will issue a proposed decision determining whether to adopt changes in response to the Rulemaking. Any CPUC Commissioner may sponsor an alternate decision. The proposed decision, and any alternate decisions, will be discussed and voted upon at a CPUC Voting Meeting.
